General Terms and Conditions of Sale

Willy writes our Terms and ConditionsThese General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) apply to any contract entered into with FERME DU MOUTTA, a simplified joint-stock company with share capital of 1,000 euros, registered with the PAU Trade and Companies Register under number 530 363 845, whose registered office is located at 40 chemin du Moutta – 64330 BOUEILH-BOUEILHO-LASQUE (hereinafter “MOUTTA FARM”), and apply to any order for products of the MOUTTA FARM brand as well as gift cards of the MOUTTA FARM brand (hereinafter the “Products”) placed on the website www.mouttafarm.co.uk (hereinafter the “Site”) by a natural person acting as a consumer or professional, within the meaning of the preliminary article of the Consumer Code, for their personal needs or for professional use (hereinafter the “Customer”).

These Terms and Conditions, drafted in English, may be amended at any time by MOUTTA FARM.

The order confirmation by the Customer constitutes full and unconditional acceptance of these Terms and Conditions, without restriction or reservation, to the exclusion of any other document. The Terms and Conditions in force on the date of confirmation shall prevail over any previous versions, as well as over those applicable in the MOUTTA FARM store.

PRODUCTS / PRICES

1.1 Product offer

The Products offered for sale are those available at the time of confirmation and payment of the order by the Customer. MOUTTA FARM reserves the right to change its offer at any time, in particular by adding, modifying or removing Products.

The Products are presented as accurately as possible. However, MOUTTA FARM cannot guarantee a perfectly faithful representation, in particular due to differences in the rendering of colours or materials depending on the Internet browsers and screens used.

The delivered Product may differ slightly from that shown on the Site without the Customer being entitled to cancel the sale in the following cases:

  1. If the Product comes from artisanal or semi-artisanal manufacturing, and perfect uniformity cannot be guaranteed.
  2. If, between the order and delivery, the Product has been adapted for technical or technological reasons.

In both cases, such differences must not affect the essential characteristics of the Products, alter their quality or lead to an increase in price.

1.2 Product prices

Prices are stated in euros, including all taxes (VAT included). Preparation and delivery costs are not included in the displayed price, unless otherwise stated.

MOUTTA FARM reserves the right to change Product prices at any time. The applicable prices are those in force on the date the order is validated by the Customer.

Some illustrations may be in 3D and are provided for guidance only. They have no contractual value and do not engage the liability of MOUTTA FARM.


ORDERS

2.1 Placing the order

Orders are placed exclusively via the MOUTTA FARM Site, either by creating a personal account (hereinafter the “Account”), or as a guest without registering. At this stage, the Customer must provide accurate personal information, such as their surname, first name and email address. It is the Customer’s responsibility to check the validity of their email address and configure their mailbox so that emails from MOUTTA FARM are not treated as spam.

All information provided by the Customer must be accurate, complete and up to date. In the event of any change in circumstances, the Customer undertakes to update their information via their Account or by contacting customer service. Account and information management is carried out solely via the Site.

The Customer also undertakes to read and accept the privacy policy of MOUTTA FARM, available on the Site, regarding the processing of personal data: Personal data. Information relating to orders is drafted in English and is archived by MOUTTA FARM for ten (10) years.

When creating their Account, the Customer chooses a personal password, which enables their identification and facilitates future connections to the Site. The Customer is responsible for keeping this password confidential and undertakes to:

  • Not disclose it to third parties;
  • Take all measures to prevent access to it by a third party;
  • Not allow anyone else to use their Account (loan, sharing, exchange, gift, transfer or sale prohibited);
  • Not use another person’s Account;
  • Use a personal, non-shared email address;
  • Allow MOUTTA FARM to contact them via this email address.

The Customer is fully responsible for the use of their Account. Any connection or action carried out using their password shall be deemed to have been performed by the Customer and under their responsibility. It is recommended to log out after each session in order to preserve the confidentiality of access.

In the event of fraudulent use or loss/theft of the password, the Customer must immediately inform MOUTTA FARM. In the event of forgetting it, the Customer may use the “Forgotten password” function to receive a new password at the email address entered in their Account.

The security of the Account is the Customer’s sole responsibility. MOUTTA FARM cannot be held liable for damage suffered by the Account or the Customer’s computer in the event of loss or disclosure of login details or passwords.

The Customer is deemed responsible for all orders placed via their Account. Orders by telephone, email, post or fax will not be taken into account.

2.2 Validation of the order

The choice and purchase of a Product are the sole responsibility of the Customer, particularly regarding the suitability of the purchase for their own needs. The Customer adds the selected Products to their basket, may check the order details, the total price, and correct or amend their order before finally validating it. It is therefore the Customer’s responsibility to check the accuracy of the information before validation. Validation is completed by payment, by which the Customer acknowledges that they have read and accepted these Terms and Conditions.

The order becomes final upon its validation, via the click on “Pay now”, without prejudice to the right of withdrawal provided for consumers in Articles L.221-18 to L.221-28 of the Consumer Code, under the conditions of Article 5.4.2 hereof, except for Products personalised at the request of the consumer Customer.

MOUTTA FARM reserves the right to refuse any order for legitimate reasons, in particular in the event of an unresolved dispute linked to a payment default on a previous order.

An order confirmation email will be sent as soon as possible, setting out the essential elements: order number, Products ordered, place of delivery, etc. The Customer agrees that this confirmation evidences the contractual relationship established with MOUTTA FARM.

In the event of unavailability of one or more ordered Product(s), MOUTTA FARM will inform the Customer by email as soon as possible. The order may then be cancelled or a new delivery date proposed, depending on the future availability of the Product.


PAYMENT

3.1 Payment

The online payment methods are detailed in the “Payment methods” tab on the Site.

3.2 Invoicing

The invoice issued by MOUTTA FARM includes the information provided by the Customer when creating or updating their Account. This information cannot be changed after the invoice has been issued.


DELIVERY

4.1 Delivery costs and methods

Delivery may be made to the shop in France, to a collection point or to the home address, in all countries offered at the time of ordering. The method of transport, lead time and corresponding costs are specified at the time of the order, depending on the place of delivery, the nature of the Products and the service chosen by the Customer.

Store collection requires presentation of the order form and a valid identity document in the customer’s name. A third party may collect the goods on presentation of the order form, their own identity document, and the original or a copy of the Customer’s identity document, together with a signed authorisation.

Delivery by carrier:

  • Small items are sent by parcel service. Eligibility for this method is specified when the order is validated.
  • Bulky items are delivered by parcel service or carrier, with a date and time slot agreed between the Customer and the carrier. The products are delivered to the address provided by the Customer when placing the order, unless another address is specified. Delivery arrangements may vary depending on the volume of the order. The Customer must check this when placing the order.

Assembly of items delivered unassembled is the Customer’s responsibility, as MOUTTA FARM does not offer this service.

The Customer must ensure, before ordering, that the Products can be transported normally to the delivery location. Any additional equipment required shall be at the Customer’s expense.

If delivery cannot be made on the scheduled date due to the Customer’s absence or a lack of information concerning any constraints, additional charges may apply or the order may be cancelled by MOUTTA FARM.

Risks relating to the Products are transferred to the Customer as soon as they are handed over by the carrier on the agreed date.

If all the Products in the same order are not available at the same time, MOUTTA FARM may offer delivery in several instalments. In this case, delivery costs will be applied to each shipment. Otherwise, delivery will take place when all the Products are available.

4.2 Receipt of delivered products

Delivery is deemed to have been completed as soon as the Product is made available to the Customer by the carrier, as evidenced by the tracking or control system used by the latter.

Each delivered Product is accompanied by a delivery or transport note, which must be signed by the Customer or by any duly authorised person.

Upon delivery, the Customer must carry out a full inspection to check for any damage, defect, missing item or apparent defect. This inspection concerns:

  • the condition of the packaging,
  • the number of parcels,
  • the conformity of the Products with the order (quantity, references, condition and characteristics).

In the event of an issue, the Customer must:
1. Record their reservations precisely and with reasons on the delivery or transport note, dated and signed. Statements such as “subject to unpacking” are insufficient;
2. Confirm their reservations to MOUTTA FARM within three (3) days after delivery.

If damage is noted at the Customer’s home, the Customer must report it on the delivery note, take photos of the damage as well as of the note with the reservations, and immediately inform the carrier and MOUTTA FARM.

More generally, the Customer must be able to prove the reality of their complaints and facilitate access for MOUTTA FARM so that it can carry out the necessary checks.

4.2.1 Cancellation of the order

MOUTTA FARM allows the Customer to reconsider their commitment and cancel their order. Partial cancellation is not possible.

Depending on the progress of the processing and the payment method, the Customer may contact customer service via the “Contact us” form available on the Site. A cancellation confirmation email will be sent, and the refund will be made within fourteen (14) days.

If cancellation is no longer possible directly, the Customer may refuse delivery:

  • Delivery to a collection point: the Customer must refuse the parcel at the collection point, then contact MOUTTA FARM customer service for the refund.
  • Home delivery: the Customer must inform the carrier when arranging the appointment or refuse the delivery at home, then contact customer service for the refund.

In these situations, return costs remain payable by the Customer and will be deducted from the refund.

In the event of failure to collect from a collection point, the order is cancelled and returned to the warehouse. The refund takes place within 14 days after receipt at the warehouse, using the same method as payment. Return costs are borne by the Customer and deducted from the refund.

In the event of home delivery, if the carrier was unable to deliver during the first two appointments because the Customer was absent, the order is cancelled, returned and refunded within 14 days after receipt, with return costs remaining payable by the Customer and deducted from the refund.

4.2.2 Exercising the right of withdrawal – Returning the order

From the date of receipt or collection of the order, the Customer has fourteen (14) working days to exercise their right of withdrawal, without having to give reasons, via the dedicated form on the Site.

This right of withdrawal applies to all MOUTTA FARM products, except personalised ones. Returned products must be in perfect condition, in their original packaging, with all accessories and the invoice.

Live animals cannot be returned due to the lack of suitable return conditions.

MOUTTA FARM reserves the right to refuse reimbursement for used or damaged products making their resale impossible, or which do not correspond to the references communicated for the return.

In the event of damage or wear to returned products, or depreciation due to handling other than that necessary to ensure their proper functioning and nature, the Customer may be held liable. MOUTTA FARM may also apply a reduction according to refurbishment costs.

To exercise their right of withdrawal, the Customer must inform MOUTTA FARM within 14 days by one of the following means:

  • Online: via the “Contact us” form.
  • By telephone: 05.31.52.0000.
  • By post: using the form provided in Appendix 1.

Online or telephone withdrawal is to be preferred.

After notifying their decision, the Customer has an additional 14 days to return the products, under the conditions mentioned above.

If these conditions are met, the Customer is reimbursed using the same payment method as the original order, for the amount of the products and the standard outbound delivery costs, within 14 days after receipt of the products in the MOUTTA FARM warehouses.

In the event of a partial return, the flat-rate outbound delivery costs relating to the original order are not reimbursed.

In all cases, return costs by post or carrier are payable by the Customer and will be communicated to you before any return.

For a refund by bank transfer, the Customer must provide their IBAN to MOUTTA FARM in order to receive the refund for the products and the standard outbound delivery costs. Delivery supplements will be refunded up to the standard amount.

For products weighing 30 kg or more, the return must be arranged by MOUTTA FARM, at the Customer’s expense, after contacting Customer Services.

4.2.3 Return for non-compliant item

The Customer benefits from the statutory warranties in the event of a lack of conformity occurring within two (2) years after purchase or delivery, in accordance with the statutory warranty of conformity and the warranty against hidden defects.

To invoke these warranties, the Customer must inform MOUTTA FARM of the non-conformity or hidden defect by one of the following means:

  • Online: via the “Contact us” form.
  • By telephone: 05.31.52.0000.

 

4.2.4 Return for item received damaged

If a product is received damaged during transport, the Customer must state their reservations precisely and with reasons on the delivery or transport note, dated and signed. Statements such as “subject to unpacking” are not sufficient.

The Customer then has three (3) working days after delivery to confirm their reservations to MOUTTA FARM, or ten (10) days if the carrier did not allow verification and no remark could be entered on the note, by one of the following means:

  • Online: via the “Contact us” form.
  • By telephone: 05.31.52.0000.

Accepted claims entitle the Customer to an exchange of the product or to a refund if the item is no longer available. In this case, MOUTTA FARM covers the return costs for any approved return.

4.2.5 Missing or unordered item

In the event of a missing, incomplete or unordered part upon delivery, the Customer must state their reservations precisely and with reasons on the delivery or transport note, dated and signed. The statement “subject to unpacking” is not sufficient.

The Customer then has three (3) working days after delivery to confirm their reservations to MOUTTA FARM, through one of the following channels:

  • Online: via the “Contact us” form.
  • By telephone: 05.31.52.0000.

If the claim is justified and accepted by MOUTTA FARM:

  • The Customer will receive the missing products or parts; or
  • In the event of unavailability, a credit note or refund will be granted according to the original payment method.

For an unordered product, MOUTTA FARM undertakes to take it back in its original packaging, in perfect condition, with all its accessories.


PRODUCT WARRANTIES

The Customer of MOUTTA FARM benefits from the statutory warranty of conformity under Article L217-4 of the French Consumer Code, valid for a minimum of two (2) years from the date shown on the invoice. This warranty does not cover wear parts or labour. Some products offer a longer warranty depending on the supplier; details are shown on the product sheet or upon simple email request on the “Contact us” page.

The warranty covers, at MOUTTA FARM’s discretion:

  • Replacement with a product of equivalent functionality,
    Replacement of the defective part(s),
    Refund in the event repair or replacement is impossible (for example, product or part unavailable).

In the event of a significant price difference, MOUTTA FARM reserves the right to choose the least costly solution.

The warranty does not apply in the following cases:

  • Normal wear and tear or abnormal/non-compliant use,
  • Negligence by the Customer in maintenance or storage,
  • Modification of the product or incompatibility with other equipment.

ENVIRONMENT

6.1 Citeo

The unique identifier FR283199_01EYDZ, assigned by CITEO to MOUTTA FARM, certifies its compliance with extended producer responsibility (EPR) requirements for household packaging and graphic paper. This identifier proves MOUTTA FARM’s commitment to reducing the environmental impact of its packaging and paper materials.

6.2 Ecomaison

The unique identifier FR283199_14GUHG, assigned by Ecomaison to MOUTTA FARM, certifies its compliance for the collection, sorting and recycling of DIY, furniture and garden items.


PERSONAL DATA

MOUTTA FARM attaches particular importance to protecting the privacy of its Customers and respecting their personal data. In this regard, MOUTTA FARM undertakes to comply with the legislation in force, in particular Regulation (EU) 2016/679 of 27 April 2016 (GDPR).

The personal data collected is mainly used for:

  • the management and monitoring of orders,
  • communications with the Customer (responses, assistance),
  • post-purchase satisfaction monitoring.

The Customer has the following rights regarding their data at any time:

  • right of access, rectification, deletion and objection,
  • right to withdraw consent,
  • right to restriction and data portability,
  • right to issue instructions concerning the fate of the data after their death,
  • right not to be subject to an automated decision,
  • right to lodge a complaint with the CNIL.

To exercise these rights, the Customer may contact MOUTTA FARM via the form on the “Contact us” page, indicating their full contact details (surname, first name, email, telephone number). MOUTTA FARM may request supporting documents to verify identity and secure the request.

For more information, the Customer is invited to consult the data processing policy (section “Personal data” on the Site).


INTELLECTUAL PROPERTY

All elements present on the Site — in particular, without this list being exhaustive, images, photographs (cut-out or in context), videos, sounds, graphic charter, logos, trademarks, models, domain names, texts and typography — constitute the exclusive property of MOUTTA FARM and are protected by the Intellectual Property Code.

MOUTTA FARM holds all intellectual property rights over its Products, trademarks, images and logos displayed on its items, packaging and communication media. These elements remain the property of MOUTTA FARM, with the exception of rights expressly held by its partners or suppliers over their trademarks, products or logos presented on the Site.

Any reproduction, representation, modification, adaptation or use, in whole or in part, of this content — by any means or medium whatsoever — without the prior written authorisation of MOUTTA FARM, is strictly prohibited.
The creation of derivative works is likewise prohibited.

No transfer of intellectual property rights is granted under these Terms and Conditions. Any unauthorised reproduction or use of a protected element shall be considered an infringement, giving rise to the civil and criminal liability of its author.


USE OF THE SITE

Any breach of these Terms and Conditions by the Customer may result in the suspension or closure of the relevant Account, without prejudice to any damages that MOUTTA FARM may claim.

The Customer is solely responsible for any activity carried out via their Account and undertakes to comply with the law, particularly regarding data protection and intellectual property.

Browsing the Site is carried out under the Customer’s sole responsibility. The Customer guarantees and shall indemnify MOUTTA FARM against any loss, claim or third-party proceedings linked to the use of the Site, including court costs and lawyers’ fees.

MOUTTA FARM undertakes, within the framework of an obligation of means, to do everything possible to ensure the proper operation of the Site and the reliability of the information found there. However, MOUTTA FARM does not guarantee uninterrupted access or a total absence of errors or interruptions.

Access to the Site may be temporarily suspended or interrupted, in particular for maintenance, updating, technical correction or for any other reason, including legal reasons.
MOUTTA FARM also reserves the right, at any time, to modify, restrict or cease publication of the Site, without prior notice or compensation.


LIMITATION OF LIABILITY AND WARRANTY OF MOUTTA FARM

10.1 Technical limitations and access to the site

MOUTTA FARM cannot be held liable for breakdowns, errors, technical failures, computer viruses or any other incident that may hinder access to or the proper functioning of the Site, nor for any direct or indirect damage resulting therefrom, particularly in the event of malfunction of the Customer’s computer equipment linked to access to the Site.

MOUTTA FARM does not guarantee the performance, stability or compatibility of the Site with certain technical configurations or particular uses. Temporary interruptions may occur for maintenance, correction, updating or for any cause beyond MOUTTA FARM’s control.

Within the limits set by law, MOUTTA FARM cannot be held liable for direct or indirect damage caused by the use of, or inability to use, the Site, or the downloading of content (images, texts, videos, etc.) from the Site.

10.2 Use and liability related to products

The Customer undertakes to comply with the instructions, precautions and recommendations shown on the Products or their packaging. MOUTTA FARM cannot be held liable for any damage resulting from improper use, negligence, lack of maintenance or use contrary to recommendations.

MOUTTA FARM’s liability is also excluded in the event of:

  • non-compliance of the Products with the legislation of the country of delivery or use,
  • use not in accordance with usual uses or with due care,
  • fault or conduct attributable to the Customer or a third party.

If MOUTTA FARM’s liability were to be engaged, it would concern only direct, personal, certain and foreseeable losses, excluding any indirect loss or damage, in particular loss of business, data or turnover.

In all cases, MOUTTA FARM’s liability is limited to the total amount of the order concerned and cannot be sought for mere errors or omissions in the presentation of the Products.

10.3 Force majeure

The occurrence of a force majeure event, as defined by Belgian case law and Article 1218 of the French Civil Code, suspends the performance of MOUTTA FARM’s obligations. Such non-performance shall not give rise to its liability.

If the force majeure lasts for more than one (1) month, MOUTTA FARM may cancel the relevant order and refund any sums that may have been paid, without any further compensation.


COMMUNICATION AND RETENTION OF THE CONTRACT

MOUTTA FARM may provide the Customer, upon request, with a copy of the sales contract for the Product.

For online sales contracts for an amount equal to or greater than one hundred and twenty (120) euros, MOUTTA FARM retains the contract for ten (10) years from delivery of the Product.

For other contracts, retention is ensured for seven (7) years.

During these periods, MOUTTA FARM guarantees permanent access to the contract for the Customer.


MISCELLANEOUS

12.1 Evidence

Email exchanges shall constitute evidence between the parties, as shall automatic recording systems, in the event of a dispute.

The Customer may obtain a copy of their contract concluded with MOUTTA FARM by sending:

  • an email via the “Contact us form,
  • a letter by post to FERME DU MOUTTA, 15 Avenue Gay Lussac – 64140 LONS (FRANCE),
    specifying all necessary information, including their order number and contact details.

 

12.2 Partial invalidity

If one or more provisions of these Terms and Conditions were declared null and void or unenforceable, the others shall remain fully applicable.

12.3 No waiver

The fact that one of the Parties does not require the application of a clause, whether temporarily or permanently, cannot be interpreted as a waiver of that right.


OPPOSITION TO TELEPHONE MARKETING

The consumer Customer, excluding the non-professional Customer within the meaning of the Consumer Code, who does not wish to receive commercial telephone solicitations, may register free of charge on the telephone marketing opt-out list:

  • online, at bloctel.gouv.fr,
  • or by post, to Worldline - Service Bloctel - CS 61311 - 41013 Blois Cedex, indicating:
    • surname
    • first name
    • address
    • the number(s) to be registered on the list and a contact number.

DISPUTES

These Terms and Conditions are governed by Belgian law. Any dispute relating to their interpretation, performance or validity shall fall within the exclusive jurisdiction of the courts of Pau.
